terms and conditions of use for individual article purchase
1. Definitions
These terms and conditions of use apply to individually purchased articles from the journals published by Wiley for the International Union of Crystallography (the `IUCr'). `Article' describes any such discrete work purchased. The purchaser of the Article is referred to herein as the `Purchaser'.2. Viewing and downloading of the Article as a PDF file
If the Article has been purchased as a Portable Document Format (PDF) file, this will be made available to the Purchaser for viewing or downloading for seven days from the date of purchase.
3. Viewing and downloading of the Article as an HTML file
If the Article has been purchased as a HyperText Mark-Up Language (HTML) file, this will be made available to the Purchaser for viewing or downloading for seven days from the date of purchase. The HTML file contains links to the appropriate graphics files on the IUCr's server, and so, for the Article to be displayed with all graphics in place, must be viewed on a computer connected to the Internet. It must also be viewed on a computer connected to the Internet to allow the use of links within the Article to other documents and services on the IUCr's server or elsewhere.
3. Copyright
Copyright ownership of the Article is indicated within both PDF and HTML versions of the Article. Copyright notices must not be removed, obscured or modified in any way. The relevant copyright notice must be displayed on all copies made from the Article.
4. Use of the Article
The Purchaser may store a copy of the Article on their local machine. The Purchaser may also store a back-up copy of the Article. Materials from the Article may not be recompiled, manipulated, used to prepare derivative works, or published in another format without prior written permission from the IUCr.
5. Disclaimers
The IUCr does not warrant that the Article itself or the graphics and linking material for the Article will be accessible in any particular hardware/software environment. The IUCr does not warrant the accuracy or completeness of any information contained in the Article, or its merchantability or fitness for a particular purpose.
The IUCr will have no liability to any person for any loss or damage arising out of use of, or inability to use, the Article.
The IUCr will make all reasonable efforts to make its server available to the Purchaser on a 24-hour basis, excluding normal network administration and system down time, but, if access is suspended or interrupted, liability will be limited to restoring access to the server as soon as practicable and, if access to the server by the Purchaser was interrupted during the seven days following the date of purchase of the Article, to providing the Purchaser with the appropriate PDF and/or HTML versions of the Article.
The IUCr reserves the right at any time to withdraw from the graphics and linking material that it makes available on its server for the Article any item or part of an item for which it no longer retains the right to publish, or which it has reasonable grounds to believe infringes copyright or is defamatory, obscene, unlawful or otherwise objectionable.
